These are the terms under which you can use UNSEEN (the mobile app) and the related services we operate at uncn.io. By installing the app or using the website you are agreeing to them. If anything below is a problem for you, please do not use UNSEEN.
1. What the service does
UNSEEN lets an organiser set up an event with a date and a capture window, then invite people to take photos and videos inside the app during that window. Nothing is visible to the guests or the organiser until the reveal date the organiser picks. Once the reveal opens, everyone who took part can see the whole set. The organiser pays a one-off fee per event; guests do not pay anything.
2. Accounts (optional)
Signing in is optional. You can create events, pay for them, attend other people's events, and view memories without ever creating an account with us. If you do want your events to survive switching phones, you can sign in with Apple on iOS or Google on Android. We do not offer email or password sign-in.
You are responsible for keeping the Apple or Google account you signed in with secure. We have no way to verify ownership of an Apple or Google account from our side, so we cannot return access to events tied to a sign-in you have lost the ability to use.
3. What you agree not to do
When you use UNSEEN you agree not to:
- capture or share content that is unlawful where the event takes place or where the other participants live;
- harass, threaten, or impersonate anyone;
- capture people who have not consented to being recorded;
- attempt to access events you were not invited to, or work around the in-app capture limits;
- reverse-engineer, scrape, or otherwise abuse the service.
If you are organising an event, you are responsible for telling the people you invite that the event is being recorded through UNSEEN and that the captures will be shared with everyone else who took part once the reveal opens.
If you break any of these rules we may remove the offending captures, suspend the account that did it, or, in serious cases, terminate access to the service.
4. Captures
You keep the copyright in whatever you take. The person who pressed the shutter owns the photo or video.
When you take a photo or video inside an event, you grant the organiser of that event a perpetual, royalty-free, non-commercial licence to use it privately together with the other people who attended the event (downloading, sharing among the same group, printing for personal use). You also grant UNSEEN a licence covering the technical operations we have to perform to run the service: hosting your file, generating the filtered version, delivering it to the other event participants, and making small improvements to the camera pipeline.
Neither the organiser nor UNSEEN may use a capture for advertising or any other commercial purpose without separate, written consent from the person who took it.
The UNSEEN name, the wordmark, the camera interface, and the website belong to us, and you do not have permission to use any of them in your own products.
5. Payments
Payments are processed by Stripe. When you pay you are also accepting Stripe's terms.
Events become non-refundable once the capture window opens. Up until then, the organiser can cancel and we will refund the full fee minus any payment processing costs we are unable to recover. Prices are shown on the create-event screen before you pay. We may change prices for future events, but doing so has no effect on events that have already been paid for. Where VAT or a similar tax applies, it is included in the price you see.
6. Service availability
We do everything we can to keep the service running, but we cannot promise it will always be available or that captures will always upload on the first try. Where the law allows us to limit our liability, the most we can be liable to you for anything that goes wrong is the amount you paid us for the event the problem relates to.
7. Ending the relationship
You can delete your account from inside the app at any time. Deleting it removes every event you created and the captures inside those events. We may suspend or terminate accounts that break these terms, and we may stop providing the service overall as long as we give you reasonable notice first.
8. Changes to these terms
If we change anything substantive in these terms we will update the date at the top. For changes that affect how you use UNSEEN or what we charge, we will also tell you inside the app before the change takes effect.
9. Governing law
These terms are governed by Portuguese law. Any dispute that cannot be resolved by writing to us first will be heard in the courts of Lisbon, Portugal. None of the above takes away any consumer protection rights you may have in your country of residence.
